Definitions  

Card means Gift Card issued by Vii Pty Limited

Card Number means the number that appears on the back of your Card.

PIN means the 4-digit Access PIN printed on the back of your Card.

This Card is issued by Vii Pty Ltd ABN 83 619 963 263 (‘we/us/our’). In these conditions ‘you’ are the Card purchaser or user. Vii Pty Limited (“Vii”) is the issuer of the Card and authorises The Card Network (“TCN”) Pty Ltd ABN 87 626 501 568 to distribute the Card.

  1. Using the Card, you agree to be bound by these Terms and Conditions. You must give these conditions to the user of the Card if that is not you. The Card remains our property.
  2. This Card is a restricted access network gift card that can be used for electronic transactions, to purchase goods and services at participating merchants listed on card website listed on the back of the card. The Card will be activated upon purchase at point of sale or the time of despatch for online or corporate orders. The card is valid for 3 years from the date of activation. You can also check the remaining period of use and the card balance at thecardnetwork.com.au. It is your responsibility to be aware of the expiry period and use the card prior.
  3. This card will work at any Restaurant, Bar or Café that accepts eftpos and has a merchant category code that corresponds to this industry type. Gift cards are still are subject to individual merchant acceptance and in accordance with these Terms & Conditions and any applicable law and subject always to the individual trading terms of each participating merchant.
  4. We are not liable for the goods or services you purchase with our Card. Any purchase made constitutes a transaction between you as the holder of the Card and the relevant merchant. You acknowledge and agree that we are not a party to that transaction, and are not in any way responsible or liable in relation to that transaction. Any dispute about goods or services purchased with a Card must be resolved with the merchant. If you think there has been an incorrectly processed transaction on your Card please contact the merchant where the transaction took place. We are unable to reverse transactions approved or processed by any merchant.
  5. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
  6. This Card is not reloadable. To check the card balance, card expiry and full conditions of use, go to www.thecardnetwork.com.au. For balance enquiries, you will be required to enter both the Card Number and Access PIN on your Card prior to getting access to the card information. The card cannot be used after expiry. At expiry, the remaining available balance will be forfeited. We will not give you any notice before this happens.
  7. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept prepaid cards). We are not liable in any way when an authorisation is declined for any particular transaction except where the authorisation has been declined because of an act or omission on our part.
  8. You acknowledge that we may allow access to the services offered on this site to anyone who enters a valid Card number and 4-digit PIN. Your PIN is simply our way of identifying you. It does not offer you any protection or security if your Card is lost, stolen or damaged. Remember to treat your Card like cash. You are solely responsible for any loss caused by use of your Card and PIN by you or any other person, including any use not approved or contemplated by you Your Card will not be replaced if misused, lost, stolen or damaged. If you notice any error or suspect any unauthorised use relating to the Card, you should notify THE CARD NETWORK immediately on 1300 375 346 during business hours or alternatively you can send an email to info@thecardnetwork.com.au
  9. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact THE CARD NETWORK on 1300 375 346 during business hours or alternatively you can send an email to info@thecardnetwork.com.au
  10. Any refunds on Card transactions are subject to the policy of the specific merchant. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.
  11. The Cards are available for purchase from specific authorised merchants listed on THE CARD NETWORK website. We cannot guarantee the validity of any Card purchased from any other merchant including any auction website or discount website who is not listed as one of our certified merchants. Any Card not purchased from a certified merchant may be fake or counterfeit or associated with fraudulent activity. We will not be liable to you or any other person for any loss arising from any purchase of our Cards from a merchant who is not listed as a certified seller.
  12. We may restrict or stop the use of the Card if suspicious activities are noticed.

  14. You are responsible for checking your transaction history online and knowing your available balance, which can be checked at www.thecardnetwork.com.au
    Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, and also where necessary to operate the Card and process transactions. A full privacy policy can be viewed at www.thecardnetwork.com.au
  15. At any time we may add or remove participating merchants and/or where the Card may be redeemed and/or add or remove goods or services which may be purchased with the Card.
  16. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions can be viewed at www.themoviecard.com.au.
  17. These Terms are to be construed and enforced in accordance with the laws of NSW, Australia. Any dispute arising from your receipt or use of a Card is exclusively subject to the jurisdiction of the courts of NSW, Australia.

    The Card Network
    Mastercard Prepaid Gift Card Conditions of Use (Terms & Conditions)

    Your Prepaid Mastercard (“Card”) is a Mastercard issued by EML Payment Solutions Limited (“EML”) ABN 30 131 436 532, AFSL 404131 (‘we/us/our’). In these terms and conditions, ‘you’ are the Card purchaser or user and by allowing the addition of the Card into your Pays-enabled device or by activating the Card, you agree to be bound by these Terms and Conditions. All users of the Card must be provided these conditions.

    Pays availability

    *When we refer to the Pays, we are referring to Apple Pay, Google Pay or Samsung Pay and further, when we refer to a Device, we are referring to a mobile phone or wearable device that allows you to store a Card to the Device. Pays availability is subject to your respective Card program sponsor and device capability. Although the Card is Pays enabled, availability of the Pays is contingent upon the card program you have signed-up for. In addition, Cardholders associated with Pays enabled programs must ensure their device is Pays capable. This means your device must have the ability to store the Card and actuate a purchase.

    Using the Card and Expiration
    1. The Card is a Mastercard prepaid card that can be used for purchasing goods and services where Mastercard prepaid cards are accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions), however limited to the merchant categories indicated by your card.
    2. The card will expire according to the month and year found on your tokenised card on your device
    3. The Card is valid until the expiry date and cannot be used after expiry.
    4. At expiry, the remaining available balance will be forfeited.

    Card Limitations
    1. The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.
    2. The Card is not reloadable.
    3. The Card is not a credit card and nor is it linked to a deposit account with us.
    4. The Card cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments.
    5. Authorisations may be declined at some merchants (such as gambling merchants or merchants who choose not to accept the Card).

    Waivers
    1. We are not liable in any way when authorisation is declined for any particular transaction except where the authorisation has been declined because of an act or omission on our part.
    2. We are not liable in circumstances where you have other cards stored on your Device for payment and you inadvertently use the Card when using your Device as a payment method. You must ensure that you select the correct card prior to using your Device as a payment method.
    3. We are not otherwise liable for the use, functionality or availability of a Device, the availability of merchants who allow the use of the Device and Card as payment, or a reduced level of service caused by the failure of third party communications and network providers (except to the extent deemed liable under the ePayments Code).
    4. We are not liable for transactions on your Card if: a) your Device security measures are compromised; or b) where you allow others access to, or the means to access, your Device; or c) any other circumstances in which you allow others to circumvent the security measures of your Device.
    5. The Card is like cash and may not be replaced if misused, lost, stolen or damaged.
    6. The Card will be void if it is defaced, mutilated, altered or tampered with in any way.

    Fees
    1. We do not charge any fees for using the Card. However, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction

    Refunds
    1. Any refunds on Card transactions are subject to the policy of the specific merchant.
    2. Refunds may be in the form of a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.

    Disputes, Complaints & General Queries
    1. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact The Card Network
    2. If you notice any error relating to the Card or have a query about the Card, you should initially contact The Card Network by phoning Client Services during business hours.

    Disclaimers
    1. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents.
    2. We may restrict or stop the use of the Card if suspicious activities are noticed
    3. You are responsible for checking your transaction history, knowing the available balance and date of expiry for the Card. Balance and transaction history are available to you within the app on your Device.
    4. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions can be viewed at www.thecardnetwork.com.au.
